MOBILEPNEUS
General terms of sale and service
MobilePneus terms for tyre sales, mobile fitting, roadside assistance and professional fleet contracts in Belgium.
1. Business identity
Mobilepneus BV / MobilePneus — Nieuwstraat 120, 1730 Asse, Belgium · VAT/company no. BE 1013.759.074 · info@mobilepneus.be · +32 488 01 49 49.
2. Scope
These terms govern requests, quotations, tyre sales, fitting, mobile interventions, roadside assistance and assistance contracts with MobilePneus. Mandatory Belgian law, including mandatory consumer protection, always prevails over any conflicting term. Written special terms or an accepted fleet contract prevail for the matters they specifically regulate.
3. Request, quotation and contract formation
A web form, WhatsApp message, phone call or appointment request is a request and does not by itself amount to final confirmation. A contract is formed when MobilePneus confirms the quotation, price or intervention in writing, or when the parties otherwise clearly agree execution. The customer must provide accurate information, including location, vehicle, tyre size, quantity and vehicle condition.
4. Prices, quotations and additional work
Price depends on the tyre, vehicle, location, time, access, travel and work required. Consumer prices are communicated in accordance with mandatory rules, including VAT and compulsory charges where the total can be calculated in advance. If an exact total cannot reasonably be calculated before inspection, the calculation method or an estimate is communicated. Additional work, parts or charges not included in the agreed scope require customer approval before billing, except an immediately necessary safety measure where legally permitted.
5. Tyres, stock and alternatives
Stock and lead times are guaranteed only after confirmation. If a reference becomes unavailable, MobilePneus may propose a compatible alternative; no paid substitution is imposed without agreement. The customer remains responsible for providing the required size, load/speed ratings and specifications when these cannot be verified on the vehicle.
6. Appointments and mobile fitting
A requested time remains a preferred slot until confirmed in writing. The customer must provide a lawful, accessible and sufficiently safe place to work. If safe work is impossible or the vehicle/wheel differs materially from the information supplied, the team may suspend or refuse the intervention. Any travel or immobilisation charge must have been disclosed or be calculable from the accepted quotation and remains subject to mandatory law.
7. Urgent roadside assistance and safety
Roadside tyre assistance does not replace emergency services. In the event of immediate danger, an accident, injury or a vehicle dangerously exposed to traffic, the customer must call 112 and follow the authorities’ instructions. If the vehicle can be moved safely, the intervention is carried out in the safest available location. Arrival time is an estimate and depends on traffic, time of day, weather, access and jobs already in progress. MobilePneus does its best to reach the customer as quickly as possible without compromising safety.
8. Cancellation and no-show
Cancellations should be notified as soon as possible. Where travel has already started or capacity was specifically reserved, only reasonable costs that were disclosed in advance or are lawfully recoverable may be charged. No fixed charge removes mandatory consumer rights. Professional customer cancellation rules may be stated in the quotation or fleet contract.
9. Consumers — withdrawal right
Where a distance or off-premises contract legally carries a withdrawal right, the consumer generally has 14 calendar days. If the consumer expressly asks for service performance to begin during that period, statutory rules on proportionate payment for work already performed apply; once the service is fully performed under the statutory conditions, the right may end. The withdrawal right does not, among other cases, apply to urgent maintenance or repair work where the consumer expressly requested the visit; additional non-essential goods or services remain subject to the applicable statutory rules. An appointment request not yet accepted by MobilePneus is not presented as a completed sale.
10. Model withdrawal notice
Where withdrawal applies, the consumer may send any unambiguous statement or use: “I hereby give notice that I withdraw from my contract for [goods/service], ordered/concluded on [date], name, address, date.” Send to info@mobilepneus.be. This does not restrict any lawful method of withdrawal.
11. Legal guarantee and conformity
For consumer sales, the Belgian legal conformity guarantee applies. For new goods, it covers lack of conformity appearing within the statutory two-year period from delivery. Any commercial warranty does not reduce that legal protection. Normal wear or damage caused by impact, incorrect inflation, misuse, overloading or a cause arising after delivery is not automatically a conformity defect.
12. Customer-supplied tyres or parts
MobilePneus may refuse to fit a tyre or part that is clearly incompatible, damaged, worn or unsafe. Where the customer supplies the item, MobilePneus remains responsible for its own fitting service as required by law, but does not assume pre-existing defects in the customer-supplied item unless the law provides otherwise.
13. Payment — consumers
Unless otherwise agreed in writing or under a fleet contract, payment is due on site at the end of the intervention. MobilePneus accepts card and cash payments. An invoice can be issued on site or sent electronically. The terms stated in the quotation or invoice remain applicable. For late consumer payments, mandatory Belgian rules apply, including the free first reminder and statutory waiting period before interest or compensation can be charged.
14. Professional customers and fleet contracts
Discounts, priority levels, centralised invoicing and payment terms apply only after written approval. The fleet contract sets prices, limits, authorised contacts, covered vehicles and intervention procedure. Belgian rules on unfair B2B contract terms remain applicable.
15. Liability
MobilePneus is liable for its own faults in accordance with applicable law. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including intentional misconduct, gross fault where exclusion is prohibited, personal injury, or mandatory consumer rights. The customer must promptly report any anomaly after an intervention and must not continue using a vehicle that is clearly unsafe.
16. Force majeure and external circumstances
MobilePneus is not liable for delay or inability to perform caused by events reasonably outside its control — such as road closures, major accidents, extreme weather, sudden supplier unavailability or authority decisions — to the extent permitted by law. The customer will be informed as soon as reasonably possible.
17. Complaints and mediation
Complaints can be sent to info@mobilepneus.be. Please describe the issue and, where useful, include the invoice, photos and intervention reference. For a consumer dispute not resolved after direct contact, the consumer may contact the Belgian Consumer Mediation Service.
18. Personal data
Data submitted for a quotation, intervention, appointment or fleet contract is processed under our privacy policy. GPS location is requested only when the user actively chooses to share it.
19. Governing law and disputes
Belgian law applies without depriving consumers of mandatory protections. Court jurisdiction is determined by the applicable legal rules; no term removes a consumer’s access to the competent court guaranteed by law.
20. Severability and changes
If a clause is invalid or unenforceable, the remaining terms continue to apply to the extent permitted by law. New versions apply to future requests and contracts and do not retroactively change an existing contract without valid agreement.
21. Trademarks
MobilePneus® is a registered trademark in the European Union, protected as both a word mark and a figurative (logo) mark. Unauthorized use of the name, logo or confusingly similar brand elements is prohibited to the extent provided by applicable law.
